The Employer-Employee Relationship: Understanding Important Legal Issues Impacting PT Private Practices through Hire, Employment, and Termination

The Employer-Employee relationship is particularly complex in the health care arena, and there are many traps and concerns of which practice administrators must be aware. Those concerns include whether new hires should be classified as independent contractors or employees, whether employees should be at-will or have a contract, whether non-competition and non-solicitation agreements will be enforced; and in what circumstances an employer's failure to comply with regulations may give rise to discrimination or whistleblower lawsuits. This session will provide you with an overview of up-to-date legal issues and pitfalls that may occur at 3 different stages of the employer-employee relationship: at hiring, during employment, and at termination. In addition, this session will provide you with examples of specific actions that may be taken by a private practice administrator to diminish exposure to legal liability.
